The AGREEMENT made this _______day of _______20___ by and between Tamauqua Real Estate Partnership hereinafter referred to as Owner and _______________________________herein refered to as Occupant.
WITNESSETH:
1. That in consideration of the premises, rents and covenants herein expressed, Owner hereby rents to Occupant and the Occupant rents from Owner, upon terms and conditions known as the Tamauqua Cottage at 11463 Richmond Lane, Conneaut Lake, PA 16316, in Huidekoper Bay Park for the term commencing at 3:00 p.m. on __________,20____. Total rent is $___________, Deposit due when placing reservation $_____________Security Deposit of $250.00 and rent balance due 30 days prior to rental occupancy.
2. Payments of said installments to: Thomas W. Hill 5036 Old William Penn Hwy. Export, Pa 15632
3. Occupant agrees to pay Owner a handling fee of $75.00 for any check returned for insufficient funds or any other reason.
4.Occupant must be 21 years or older.
5.The Occupant agrees to pay the sum of $250.00 as security for the faithful performance by Occupant of the obligations hereunder. In the event of any breach of failure of the Occupant hereunder, the Owner shall have the right to use and apply the said security deposit in the manner provided herein and permitted by law. Within seventy-two (72) hours following termination of tenancy, Owner or their designee shall make a final inspection of the premises. If Occupant has faithfully performed his obligations hereunder, paid all rent and other charges due Owner, returned all keys, and left the premises ( including all fixtures, facilities and appliances) in the same condition as when premises were first ocuupied except for reasonable wear and tear and normal depreciation, the Owner shall immediately return the amount of security deposit to the Occupant (or destroy check). If the Owner has made any deductions from security deposit all said deductions shall be fully itemized in writing to Occupant.
6.Occupant shall use in a reasonable manner all electrical, plumbing, sanitary, heating and other fixtures, facilities, and appliances in the premises and occupant shall be charged for any repairs for damage caused by his failure to comply with this requirement.
7. The premises are rented furnished and are equipped with the following appliances: gas stove, refridgerator, microwave, toaster, coffee maker, color TV and outdoor grill.
8. Occupant shall not deliberately or negligently destroy, deface, damage, impair or remove any part of the premises (including fixtures, facilities or appliances) or permit any person to do so, whether act was condoned by the Occupant or not and Occupant shall be responsible for all damage caused by the failure to comply with the requirement.
9.Occupant shall not keep pets on premises.
10.The Occupant agrees to follow the rules and expected code of conduct of the Huidekoper Association and to require all those on the premises to follow said rules. Inaddition the occupant covenants and agrees that he/she will not use nor permit to be used the premises for improper, illegal or immoral purposes. Nor will she/he use permit or suffer the same to be used by any person or persons in a noisy, dangerous, offensive, illegal or improper manner.
11. The Occupant agrees not to make any copies of keys of the premises and upon termination of the rental aggreement the Occupant shall surrender all keys to the premises. The owner shall not be responsible for the protection of Occupant from violent or criminal acts on or off premises.
12. All personal property placed on the rental premises or in any other portion of the property on which the premises is located shall be at the sole risk of the Occupant or the parties owning the same. The Owner shall in no event be responsible for the loss, destruction, theft, or damage to said property unless caused by the negligence of the Owner or his employees.
13. It is understood and agreed that in the case of the violation of the agreement in any way by the Occupant the Owner hereby is expressly given the right to take any action stated herein and all other actions not state herein but wihich are allowable by law.
14. Owner and Occupant agree the in the event of any litigation with respect to the Rental Agreement the proper forum for such litigation would be Crawford County PA. In the event that the Owner uses an attorney to enforce the Agreemjent, Owner is entitled to collect attorney's fees in addition to rents and damages from Occupant.
15. If the rental amounts and deposits are not paid as required or if any checks are returned by Occupant's bank unpaid, Owner may at his option void this agreement. If so voided Owner will give immediate notice to Occupant.
16. Occupant shall defend, hold harmless, and indemnify Owner for and against all claims and liabilities (including attorney fees), for personal injury (including death) property damage or other claims and liabilities arising out of, related to, or in connection with Occupants negligent errors or willful misconduct.
The Rental Agreement is the entire agreement between the parties and no modification or addition to it shall be binding unless put into writing and signed by all parties hereto. The covinenants, conditions and agreements contained herein are binding upon and shall inure to the benefit of the parties hereto. Parties signing the agreement shall be jointly liable. Whatever the context requires the singular number shall include the plural, the plural the singular, and the use of any gender shall include the other gender.
